It's kind of a clusterfuck situation, but I doubt he's yours. Your offer isn't even better than Smarch's original one (I'm presuming that Smarch's offer was always $2.25M since that's the minimum salary for him) and you offered him a 2 year deal when inactives are only allowed one year max.
